This is a translation. If it differs from the Spanish version, the Spanish version prevails.
1. Who we are
Alenta (“Alenta”, “we”) is a service based in the Dominican Republic. The company’s legal details will be published here soon. Contact: [email protected].
2. Who they apply to
These terms apply to trainers who subscribe to Alenta (“Trainer”) and to people who use a Trainer’s app (“Client”). If you use a Trainer’s app, your training, nutrition and payment relationship is with that Trainer, not with Alenta.
3. The service
Alenta gives the Trainer an app under their own brand to manage workouts, nutrition, challenges, chat, payment verification and reports with their Clients. The app is installed from a link provided by the Trainer. Publishing on the App Store and Google Play is an additional service.
4. Not a medical service
Alenta is a management tool. It does not provide medical or nutritional diagnoses or treatment. Plans are created and published by the Trainer. Before starting an exercise program or a diet, the Client should consult a doctor, especially if they have a health condition, are pregnant or take medication.
5. Accounts
You must provide accurate information and keep your password safe. The Trainer is responsible for who they invite to their app. Use by anyone under 18 requires the consent of their parent or guardian, which the Trainer must obtain.
6. Trainer obligations
The Trainer agrees to: have their Clients’ authorization to process their data, including health data; publish only content they own or have the right to use; not use the app for illegal or misleading purposes, or in ways that put their Clients’ health at risk; and review every AI-generated draft before publishing it.
7. Payments between Trainer and Client
Clients pay the Trainer directly, by bank transfer or any other method the Trainer specifies. Alenta does not receive, hold or process that money and is not a party to that relationship. The app only lets users upload and verify receipts. Claims about payments, refunds or services are settled between the Trainer and the Client.
8. Trainer subscription
The Trainer pays Alenta according to the plan and the contract they sign. That contract sets out the price, term, renewal and cancellation. Extras are quoted separately. If a payment is late, we may suspend the account after giving notice.
9. Artificial intelligence
Alenta uses AI providers (Anthropic and OpenAI) to generate drafts of routines, meal plans, food images and progress summaries. Results may contain errors: they are drafts that the Trainer reviews and decides whether to publish. Under these providers’ business terms, data sent to them is not used to train their models.
10. Intellectual property
The Trainer’s brand, logo and content belong to the Trainer, who grants us permission to use them only to provide the service. The platform, the software and the Alenta brand belong to Alenta. Each Client’s data and content remain the Client’s.
11. Personal data
For their Clients’ data, the Trainer is the controller and Alenta acts as processor, following the Trainer’s instructions and the Data Processing Addendum signed with each Trainer. Details in the privacy policy.
12. Availability
We work to keep the app available at all times, but there may be interruptions for maintenance or third-party failures. We will give advance notice of scheduled maintenance when possible.
13. Liability
To the extent permitted by law, Alenta is not liable for injuries or damages arising from plans published by the Trainer, or for payments between Trainer and Client. Alenta’s total liability to the Trainer is limited to what their contract sets out.
14. End of service
Before the subscription ends, the Trainer may ask us for a copy of their account data. We then delete it, except for anything the law requires us to keep.
15. Changes
If we change these terms, we will give advance notice through the app or by email.
16. Governing law
These terms are governed by the laws of the Dominican Republic. Any dispute is submitted to the Dominican courts.
